code enforcement board to discuss property cleanup

HENDERSON, KY, January 26, 2021- The Code Enforcement Board for the City of Henderson will meet in special session on

Thursday, Jan. 28, to hear an update about clean-up of the downtown Henderson property at 239 First St.

The meeting is set for 9 a.m. in the third-floor Assembly Room at Henderson Municipal Center.

At a special meeting on Dec. 18, the citizen board set a deadline of Jan. 28 for receiving a definitive clean-up plan
from the owners.
Prior to the Dec. 18 meeting, the property owners (Audubon Loans LLC) received a citation from the city Codes Department

regarding the unsafe condition of the property and they were contesting it before the board.

The board heard testimony that the owners appealed a ruling from the state of Kentucky Division of Air about where the

debris from the building will need to be disposed.

The Kentucky Division of Air has final jurisdiction about the location for disposal of materials and the method by

which it should be done.

At the Dec. 18 meeting, the Code Enforcement Board approved a plan to give the property owners 30 days to finalize

their clean-up plan and to start the clock running on Dec. 28. Meanwhile, the Codes Department was directed to assess

a $200 per work day codes violation fine starting Dec. 28 to be reviewed at the Jan. 28.

The building partially collapsed on the evening of Aug. 21 and was razed the following day out of public safety concerns.
